I was told today by my financial adviser that my Marazion solicitor is not on the bank Conveyancing panel. How can I be sure whether this is correct?
The first thing you need to do is to call your Marazion lawyer directly. It is reasonable to expect your lawyer to notify you of the situation. If they are not on the panel they may be able to suggest a Marazion conveyancing firm that is on the approved list of lawyers for your bank.
My husband and I changing mortgage lender for our maisonette in Marazion with Nottingham. We have a son approaching twenty who lives at home. Our solicitor has asked us to disclose any adults other than ourselves who reside at the property. Our lawyer has now e-mailed a document for our son to sign, waiving any legal rights in the event that the flat is repossessed. I have a couple of questions (1) Is this form unique to the Nottingham conveyancing panel as he never had to sign this form when we remortgaged 5 years ago (2) Does our son by signing this giving up his rights to inherit the property?
First, rest assured that your Nottingham conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Nottingham. This is solely used to protect Nottingham if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Nottingham had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.
I understand that there are debates on Chancel Insurance on online forums. Do I need chancel insurance when acquiring a house in Marazion? or Apparently there is a law dating back centuries that could mean that homeowners living in a parish church boundary may be liable to contribute towards maintenance to the chancel within the church. Is this applicable for conveyancing in Marazion?
Unless a previous acquisition of the house took place post 12 October 2013 you could expect conveyancing practitioners carrying out conveyancing in Marazion to continue to recommend a chancel search and or insurance against a claim.
I've recently found out that there is a flying freehold element on a house I have offered on a fortnight ago in what should have been a simple, no chain conveyancing. Marazion is the location of the property. Is there any advice you can impart?
Flying freeholds in Marazion are not the norm but are more likely to exist in relation to terraced houses. Even though you don't necessarily need a conveyancing solicitor in Marazion you would need to get your solicitor to go through the deeds diligently. Your bank may require your conveyancing solicitor to take out an indemnity policy. Some of the more diligent conveyancing solicitors in Marazion may determine that this is not enough and that the deeds be re-written to give you the most up to date legal protection. If so, the next door neighbour also had to sign up to the revised deeds. It is possible that your lender will not accept the situation so the sooner you find out the better. You should also check with your insurance broker as to whether they will insure a flying freehold property.
Hoping to buy a property located in Marazion and I am already nervous. I couldn't find anything specific about Marazion. Conveyancing will be needed in due course but do you know about the Marazion area? or perhaps some other tips you can share?
Rather than looking online forget looking online you should go and have a look at Marazion. In the meantime here are some basic statistics that we found
I am in need of some leasehold conveyancing in Marazion. Before I set the wheels in motion I require certainty as to the remaining lease term.
If the lease is registered - and 99.9% are in Marazion - then the leasehold title will always include the short particulars of the lease, namely the date; the term; and the original parties. From a conveyancing perspective such details then enable any prospective buyer and lender to confirm that any lease they are looking at is the one relevant to that title. For any other purpose, such as confirming how long the term was granted for and calculating what is left, then the register should be sufficient on it's own.
