It has come to my attention via my financial adviser that my Marazion the law firm I have appointed is not on the lender Solicitor panel. How can I check?
You need to call your Marazion conveyancer. It is reasonable to expect your lawyer to inform you of the situation. Where they are not on the panel they could put your in touch with solicitors on the approved list of lawyers for your lender.
My fiance and I intend to remortgage our penthouse in Marazion with Principality. We have a son 19 who lives with us. Our solicitor requested us to identify any adults other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, waiving any legal rights in the event that the apartment is forfeited by the lender. I have two concerns (1) Is this document specific to the Principality conveyancing panel as he did not need to sign this form when we remortgaged 4 years ago (2) Does our son by signing this extinguish his entitlement to inherit the property?
First, rest assured that your Principality conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Principality. This is solely used to protect Principality if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Principality had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.
We are purchasing a house and the solicitor has mentioned Chancel Repair to which the house may be liable as it falls into the area of such a church. He has recommended insurance. Is this really required for conveyancing in Marazion
Unless a previous acquisition of the property completed after 12 October 2013 you could assume that solicitors conducting conveyancing in Marazion to remain encouraging a chancel search and or insurance against a claim.
Yesterday I discovered that there is a flying freehold issue on a house I put an offer in a fortnight ago in what should have been a simple, chain free conveyancing. Marazion is the location of the property. Is there any guidance you can impart?
Flying freeholds in Marazion are unusual but are more likely to exist in relation to terraced houses. Even where you use a solicitor outside Marazion you must be sure that your lawyer goes through the deeds thoroughly. Your bank may require your conveyancing solicitor to take out an indemnity policy. Some of the more diligent conveyancing solicitors in Marazion may determine that this is not enough and that the deeds be re-written to give you the most up to date legal protection. If so, the next door neighbour also had to sign up to the revised deeds. It is possible that your lender will not accept the situation so the sooner you find out the better. You should also check with your insurance broker as to whether they will insure a flying freehold premises.
Hoping to buy a property located in Marazion and I am already nervous. I couldn't find anything specific about Marazion. Conveyancing will be needed in due course but do you know about the Marazion area? or perhaps some other tips you can share?
Rather than looking online forget looking online you should go and have a look at Marazion. In the meantime here are some basic statistics that we found
I am in need of some leasehold conveyancing in Marazion. Before diving in I want to be sure as to the remaining lease term.
If the lease is recorded at the land registry - and almost all are in Marazion - then the leasehold title will always include the basic details of the lease, namely the date; the term; and the original parties. From a conveyancing perspective such details then enable any prospective buyer and lender to confirm that any lease they are looking at is the one relevant to that title. For any other purpose, such as confirming how long the term was granted for and calculating what is left, then the register should be sufficient on it's own.

Plenty Marazion leasehold properties will have a service bill for the upkeep of the building invoiced by the landlord. Where you acquire the property you will have to meet this contribution, usually in instalments accross the year. This can differ from a few hundred pounds to thousands of pounds for buildings with lifts and large communal grounds. There will also be a ground rent for you to pay annual, this is usually not a large figure, say approximately £50-£100 but you need to check it because sometimes it could be many hundreds of pounds. How much is the ground rent and service charge? Is the freehold owned jointly by the tenants?
